A party participating in an offered Trip and/or the party who purchases, or attempts to purchase, a Trip for themselves and/or others are referred to as "Traveler," "you," or "your" in this document.
All Flybackindia Trip bookings are also subject to the terms and conditions of the service provider involved in the trip. By placing a purchase with Flybackindia, you agree to accept without reservation all of the applicable Suppliers' Terms and Conditions, as well as the limits set out therein. If the Supplier's Terms and Conditions contradict with Flybackindia's Terms and Conditions, Flybackindia's Terms and Conditions will govern all issues relating to Flybackindia's duties and responsibilities. It is also important that you read and accept our Terms and Conditions before making a booking, particularly to ascertain which terms are in effect at the time, in case they have changed since the last time you ordered from Flybackindia or reviewed our Terms and Conditions.
3. Payments-
I accept that if I owe LMT Travels INC money and do not make satisfactory payment arrangements, my account may be turned over to an outside collection agency. I will be responsible for all fees charged by the collection agency, including any charges and expenditures incurred in the collection of my account, as well as possible reasonable attorney's fees incurred throughout the collection process. 5. Cancellations and Alterations Policies -
Our Cancellation and Alteration Policies differ depending on the Service and/or Trip purchased. Prior to purchase, these can be viewed in writing via an email sent to the buyer. If you have any questions, please contact one of our agents at the time of sale or at any time prior to purchase.
6. CHANGES AFTER PURCHASE:
All changes to a booking made after it has been purchased are restricted and are subject to the airline fare rules. Changes to flight dates and times are subject to availability and payment of a change charge per person, plus any additional costs incurred as a result of the difference between the original total price paid and the lowest total price available for the new flight at the time the change is made. Any confirmation made outside of the allowed time range may incur additional fees, which you will be notified of through email. If you do not return the confirmation document, your original reservation will be honoured.
1. Our Suppliers may charge you for any cancellations or changes to your booking, and our administrative expenses may be charged on top of that. These expenses will be billed to you in the event of a change. These charges are deducted from the reimbursement due to you under this agreement in the event of cancellation.
2. If you cancel your booking for any reason, you are still responsible for paying all of the amounts owed to Flybackindia. You are not entitled to a refund if your stay is interrupted or reduced, or if any Service is not really used by you for any reason (for example, if you fail to arrive in time to enjoy the Services).
3. In general, any changes, regardless of their nature, are handled as a cancellation followed by a new booking, resulting in the applicable cancellation fees. These fees will be added to any costs incurred by the Supplier, which you will be advised of prior to the change being implemented.
4. *California and Illinois Residents only:
Unless the Traveler advises the seller of travel in writing, all sums paid to the seller of travel for services not provided will be promptly paid to the Traveler upon cancellation of the transportation or travel services, where the Traveler is not at fault and has not cancelled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the Traveler. This provision does not apply in California if the travel seller has remitted the payment to another registered wholesale travel seller or a carrier without receiving a refund and the wholesaler or provider fails to provide the agreed-upon transportation or service. In this case, the travel seller must give the Traveler with a written statement, bank records proving the payment's distribution, and, if the payment was disbursed to a wholesale travel seller, confirmation of that wholesaler's current registration.
We have had to make adjustments to and cancel confirmed bookings on occasion due to political or environmental developments, rescheduling of plane routes and schedules, and other situations beyond our control. While we try to minimise modifications and cancellations as much as possible, we must reserve the right to do so. The most of the modifications are modest. On occasion, we must make a "major shift." A significant modification is one made before departure that we can reasonably expect to have a significant impact on your confirmed Trip based on the information you provide at the time of booking.When made before departure, significant changes are likely to include the following: a change of accommodation to one of a lower standard for the entire or a significant portion of the time you are away, a change of area of travel for the entire or a significant portion of the time, a change of outward departure time or an overall length of time you are away of twelve or more hours. We will tell you as soon as possible if we need to make a significant adjustment or cancel. We will make every effort to provide you with alternate routing and/or dates, as well as at least one option of comparable quality and pricing. If time permits prior to departure, we will provide you with the following options.
Please keep in mind that the above choices are not available if the modification is modest. If we have to make a significant modification or cancel, we will pay you appropriate compensation based on the circumstances and when you are notified of the significant change or cancellation, with the following exceptions.
We may be forced to amend or terminate your Trip due to "force majeure" after departure but before the stated end date. Although this is extremely unlikely, we regret that we will be unable to offer any refunds (unless we receive reimbursements from our suppliers), compensate you, or cover any charges or expenses you suffer as a result of this circumstance.

b. buying an alternative Trip from us, if one is available, that is of comparable quality to the one initially booked. We shall make every effort to provide you with at least one comparable alternative trip for which you will not be charged more than the original trip fee. If this trip is indeed less expensive than the original, we will repay the difference. You may choose any of the alternative arrangements we have available if You do not desire to accept the Trip we expressly offer You. Any such alternative arrangements must be paid for at the corresponding price. This means you'll pay more if they're more expensive, or you'll get a refund if they're less expensive.
c. cancelling or accepting the cancellation, in which case you will be refunded in full for all amounts paid to us.
d. Where we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care, no compensation will be payable and no liability will be accepted beyond offering the above mentioned options.
e. If we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel, no compensation will be paid and the foregoing options will be unavailable (such as paying on time). Cancellations and Alterations attributable to You
Important : unless stated differently, all airline ticket and vacation package bookings are non-refundable. Any change, transfer, or cancellation of airfare or dynamic packages (flight + hotel) affecting the booked flight(s) will result in costs up to the price of the air tickets purchased, including all fees, taxes, and charges. Cancellations can only be made over the phone. Only if the following requirements are met may we consider refund requests:
All refund requests follow a standard procedure. You will receive an email message recognising your cancellation request after it has been sent to our customer service agent. This acknowledgement does not imply that you are entitled to a refund. We work with the airline or any involved providers to establish a waiver and, if the fare regulations allow, process the refund. Cancellation fees vary depending on the fare rules, and refunds can take up to 4-6 weeks to process.

7.Issuing Travel Documents -
The method for issuing travel documents and/or tickets is determined by the amount of time between the date of issue and your departure date, as well as the kind of Service. If a Traveler gives false information, Flybackindia will not be held liable if the Trip is harmed or made impossible as a result of the non-receipt of travel documents. 8. Insurance -

9. Passports, Visas, Health Requirements, and Travel Risks -
It is the responsibility of the traveller to ensure that they have the appropriate visas, passports, and immunizations before departing. All persons travelling to any of the destinations outside of the United States that we feature must have a full and valid passport. For the duration of your trip, you must obtain and maintain a valid passport, as well as any necessary visas, permits, and certifications, as well as vaccination certificates. 10. Accommodations (Hotels) & Car Rentals -

Flybackindia uses third-party Vendors to supply lodgings for its Trips and has no ownership or managerial stake in those accommodations. . Flybackindia does not guarantee the Accommodations' location or features, nor the performance of third-party Vendors. Please contact the owner/operators of the respective Accommodations immediately if any concerns emerge. • Unless otherwise stated, all accommodation prices are based on double occupancy. If you choose single accommodations, you may be charged a single supplement cost, which varies based on the kind of accommodation. For Hotel & Car rental bookings At check-in, the reservation holder must show a valid photo ID and payment card. The credit card is required for any additional hotel specific service fees, incidental charges, or fees that may be charged by the hotel at checkout, in addition to guaranteeing the reservation. These fees are not included in your per night pricing and may be necessary (e.g., resort fees) or optional (e.g., parking, phone calls, or minibar charges). At the time of pick-up, the vehicle's renter must be present to sign the rental agreement and supply their credit card. 12. Local Customs and Laws -
Some travellers may be visiting foreign countries, which will have different customs, standards, laws, and risks than their home country. The traveller recognises that he or she must be prepared to deal with the unexpected, local customs and shortages, weather, travel, and humanity in general. As a result, the Traveler understands and accepts the dangers of travelling in a foreign nation and agrees to discharge and keep Flybackindia blameless for any such issues that arise during their Trip.
All travellers must follow the rules and regulations of the nations they visit while on their journey. Flybackindia is not responsible or liable for any damages, fines, or additional expenses incurred as a result of the Traveler's failure to follow any municipal, provincial, or federal laws.
13. Legal Compliance and Proper Conduct -
Traveler understands that if Traveler is disciplined by any civil or criminal authorities, charter operator, or if Flybackindia, in its sole discretion, determines that Traveler's conduct is incompatible with the interests, safety, or welfare of other Travelers or Service providers, their employees, or independent contractors, Traveler's participation in a Trip may be terminated. In this case, the Traveler is responsible for organising and paying for alternate transportation and lodging.
14. Marketing Materials -
Flybackindia makes every effort to depict the services it provides using images or illustrations that are accurate representations of the services. Please keep in mind that images and illustrations used in descriptions are strictly for illustration purposes. They bind Flybackindia only to the extent that they depict the type or standard of such Services; therefore are not contractual, and they should not be understood as assurances of the circumstances of the places or accommodations depicted at the time of your Trip.
3. The travel information we provide on our site and in newsletters, brochures, and other materials about options for accommodations, excursions, restaurants, bars/clubs, and other activities comes from a variety of sources, including information published by the establishments themselves, other travel guides, and on-line research, and is believed to be accurate. However, some of the data could not be independently verified and could be erroneous or out of date. You should not take the material as advice, and you should conduct your own research to ensure that the business or website in issue is still active and meets your requirements.
Flybackindia may use statements made by its Travelers, as well as their photographs, images, or other likenesses, in marketing materials, on our website, or at promotional events on occasion. 16. Disclaimer of Warranties -
FLYBACKINDIA PROVIDES ALL GOODS AND SERVICES ON AN "AS IS," "AS AVAILABLE" BASIS, UNLESS OTHERWISE STATED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, FLYBACKINDIA DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED Indemnification and Release - Traveler hereby releases Flybackindia from any and all liability, loss, expense, damages, or claims arising out of or resulting from Traveler's participation in a Trip, whether caused by Traveler's negligent, intentional, or reckless conduct, the conduct of a Service Provider, a provider of Accommodations, another third party, or otherwise.
Traveler also agrees to indemnify, defend, and hold Flybackindia harmless from and against any and all damages, losses, claims, liabilities, deficiencies, costs, fees (including reasonable attorneys' fees), and expenses arising out of any claim brought against Flybackindia relating to, resulting from, or arising from Traveler's participation in a Trip or Traveler's performance of this Agreement.
17. Force Majeure -
Flybackindia will not be liable for inability to play out any of its commitments under this Agreement during any period in which such execution is forestalled or postponed because of Force Majeure. • You will not be entitled to a refund if your trip is stopped or abbreviated, or if you do not use a service. If you have purchased insurance, particularly insurance for the interruption of a stay, you must follow the cancellation procedures outlined in your insurance contract.
The airlines reserve the right to arrange transportation by any other means (coach/bus, train, etc.) if any booked flight connecting with your departure or inbound flight is cancelled or delayed.
If you are organising your own connecting transportation with Flybackindia's arrangements, we recommend that you reserve flexible or refundable tickets to minimise any financial loss. It's also a good idea to avoid making any essential appointments on the day after your return. Flybackindia cannot be held liable for the effects of delays (such as a cancelled planned flight) resulting from connecting transportation that you have arranged.
• It is important that the return be re-confirmed locally with the airline within 72 hours of the anticipated departure date, regardless of the kind of flight, scheduled or charter. This formality is usually handled by the local representative or agency for package trips. We would like to call your attention to the fact that this procedure is required and that if you do not complete it, the airline will not be able to guarantee your seat and may assign it to someone else. Furthermore, this step allows you to double-check the times of your return flight, which may have changed in the meanwhile. Flybackindia is not responsible for your failure to re-confirm your return flight due to negligence on your side.
Flybackindia accepts no responsibility for any loss or damage to baggage or personal effects during or in transit to or from a Trip. The airline is solely accountable to you for the baggage you entrust to it to the extent that the international conventions and relevant regulations provide for reimbursement. If your luggage is damaged, delayed, stolen, or lost, you must contact your airline and declare the damage, absence, or loss of your personal effects before leaving the airport, and then submit a declaration with the originals of the following documents: the travel ticket, baggage check-in slip, and declaration. It is advised that you purchase an insurance that covers the worth of your belongings. Fees for extra and oversized baggage: Each airline has its own luggage policy. Check with your airline ahead of time to see if there are any weight limitations or additional baggage fees. Any additional charges for checked or overweight baggage, such as golf bags and oversized luggage, will be your responsibility to pay to the airline. You must pay a surcharge directly to the airline at the airport if you exceed the weight restriction stated by your airline and extra weight is authorised.
Babies (under the age of two) are not allowed to sit in a seat, and the ticket price is usually 10% less than the official rate. Except on charter flights, children (aged 2 to 11) may be eligible for a discount on select flights.
Different airlines have different policies about when pregnant women can fly on board planes, with limits ranging from 7 to 30 days before the due date. It is your duty to check your specific airline's regulations. Flybackindia shall not be liable for any cancellation fees or charges incurred as a result of your refusal to board.
19. Representations and Warranties -
Traveler represents and warrants that Traveler: (1) has all necessary power and authority to enter into and perform the obligations set forth in these Terms and Conditions; (ii) will abide by all applicable laws, rules, and regulations, and will make every effort to follow all local customs; and (iii) all information provided to Flybackindia in order to facilitate Traveler's Trip is true and accurate. Traveler permits Flybackindia to conduct any investigations that Flybackindia deems necessary to assess Traveler's eligibility, at their exclusive discretion.
20. Medical and Physical Conditions; Medical Emergencies -
Medical Emergencies.You must be in good physical shape and health to engage in some of the activities featured on Flybackindia's Trips because they are physically active and interactive. Various water activities and sports (such as jet skiing, snorkelling, and surfing) need a variety of skills and talents, including the ability to swim, hand-eye coordination, balance, and awareness of your surroundings. Before participating in an adventure or water activity while on a Trip, the traveller declares that they will not consume any alcoholic beverages or medicines that may impair their physical or mental capacities.
During their Trip, the traveller confirms that they are responsible for managing their own medication, medical, physical, or allergy concerns. Traveler knows that Flybackindia may not be held liable in the event of injury or exacerbation of Traveler's medical condition. If a major emergency occurs, a physician may be required to attend to Traveler, but Traveler understands that Flybackindia is not compelled to enable or aid that care. Flybackindia has no control over the quality of medical personnel and facilities that vary from place to region. Substandard medical care is frequent and unavoidable in various places of the world. Hospital facilities are frequently unavailable, and evacuation is generally time-consuming, difficult, and costly. Flybackindia is not responsible for the price of any medical treatment you may require while on a Trip and bears no obligation for the medical services you may obtain or the lack thereof while on the Trip. YOU ARE RESPONSIBLE FOR ANY AND ALL MEDICAL TREATMENTS YOU MAY REQUIRE OR RECEIVE DURING YOUR TRIP, AS WELL AS THE RISKS AND COSTS INVOLVED. Traveler agrees to be responsible for any and all medical expenditures incurred, whether secured by a Service provider on behalf of Traveler, Flybackindia, or otherwise.
21. Attorney's Fees, Costs, and Expenses of Suit -
If any action in law or equity is brought to enforce, interpret, or construe the provisions of these Terms and Conditions, a Trip, our Privacy Policy, Flybackindia's website, or any literature or materials concerning Flybackindia, the prevailing party shall be entitled to recover actual reasonable attorney's fees, costs, and expense.
21. Assignment -
Traveler may not assign his or her rights or duties under this agreement without Flybackindia's prior written consent.
23.Severability and Survivability -
If any provision of these Terms and Conditions, or part of a provision, is found to be unlawful, void, or unenforceable for any reason, that provision will be deemed severable and will not affect the validity and enforceability of the other provisions. Traveler and Flybackindia agree to replace the severed provision with a lawful provision that most closely approximates its intent and economic effect.
• Any provision of these Terms and Conditions that imposes or envisions continuing obligations on a party will survive the expiration or termination of these Terms and Conditions, notwithstanding any other provisions of these Terms and Conditions or any general legal principles to the contrary.
24. Entire Agreement, Waiver, Etc. -
These Terms and Conditions represent the parties' full understanding and agreement with respect to the subject matter covered by them, and supersede all prior and contemporaneous understandings and agreements with respect to such subject matter, whether written or oral. Any terms contained in any proposal, purchase order, acknowledgment, or other document will have no influence on the terms of this agreement. No delay or failure by any party to exercise or enforce any right or term of this Agreement at any time will be construed as a waiver of that party's rights to do so in the future. A single waiver does not imply a future or continuous waiver. Flybackindia does not promise that all violations of these Terms & Conditions will be addressed. Any waiver, modification, or alteration to this Agreement must be in writing and signed by both parties.
